Advantages
- Major principles would be entrenched, safeguarding them from interference.
- Individual liberty will be more protected due to entrenchement.
- The power of the executive would be constrained by a rigid codified document.
- Independent judges are would be able to protect the constitution to ensure it is upheld.
|
Disadvantages
- Less responsive and adaptable than an uncodified constitution.
- Despite entrenchement, it can still fail to protect rights. Eg. African-Americans being lynched despite the Bill of Rights.
- Government power may be more effectively constrained be regular elections than by a constitutional document.
- Judges are not the best people to regulate the constitution as they are unelected.
