What are the disadvantages of a Summary Judgment?
Claimant must show that there is no real prospect of success and as the court has the discretion of costs, if the application is unsuccessful, the claimant may be ordered to pay the costs of the other party as well as their own.

What are the correct timings in regard to Summary Judgments?
The application must be served at least 14 days before the hearing. If the application is opposed by the third party, written evidence needs to be served at least 7 days prior to the hearing. Any evidence in response must be filed and served at least 3 da

Form N244 has to be sent with evidence and reasoning. Skeleton arguments and bundles should be prepared along with a draft order filed with the application.
