  • Court only see it as valid if its intended as an offer
  • The person making the offer - OFFEROR
  • The person to whom the offer is made - OFFEREE

Distinction Between offer and invitation to treat

  • Must be legally recognised offer, if the other person is to accept. Invitation to treat is not recognised by the law as an offer it is where the person is inviting you to make an offer.
  • 3 important situations which are always invitations to treat and not offers are:
    • Articles for sale in a Shop Window or shelf - FISHER V BELL (1961)
    • Magazine Advert (also newspapers, catalogues and internet, only exception is reward posters) -
