When the State accuses someone of a crime
The state punishes individuals/ groups or businesses for crimes against the state (breaking the law).
Criminal law is to protect the community
Protect individuals from harm
Protect property from harm
Preserve order in society
Punish those who deserve punishment
Usually prosecuted by the Crown Prosecution Service
Prosecution has to prove the case beyond a reasonable doubt (known as standard of proof)
Case is heard in the criminal courts- either by
Crown Court – more serious crimes
Magistrates- less serious crimes
