Introducing Law
What is Law?
- Law is a set of rules. There are many organisations that have rules, but rules become law when they are created or recognised by the Government - the rules are then enforced by the courts. They are 'recognised and applied by the state'.
Why do we need Law?
- To keep public order
- To protect individual freedoms
- To regulate relationships
- To set standards
- To provide solutions to legal problems
Classification of Law
There are many different types of law in England and Wales. Law can be divided up in several ways.
International and national Law
International Law - Governs disputes between nations
National Law - Concerned with only the rules of one country
Private and public Law
Public Law - Involves the State or Government in some way
Private Law (Civil Law) - Concerned with disputes between individuals and businesses
Both private and public law can be further divided.
For public law
- Constitutional law
- Administrative law
- Criminal law
For Private law
- Contract
- Tort
- Family Law
- Company law and many other areas.
Differences between civil and criminal law
Criminal Cases
- When the State accuses someone of a crime
- Usually prosecuted by the Crown Prosecution Service.
- Take place in the Magistrates' Court or the Crown Court
- Purpose of trail is to decide whether defendant is guilty or not guilty
- When someone pleads guilty or is found guilty, they are setenced.
