- Translates literally from Latin into the guilty act
- Omission
- Failure to act
- General rule is that an omission doesnt result in actus reus
- However an omission can be actus reus in a number of situations:
- Statutory duty - e.g. appeal for bail
- Contractual duty - R v Pitwood
- Assumed duty - Stone & Dobinson
- Duty of law enforcement - R v Dytham
- Familial relationship - R v Gibbens & Proctor
- Continuing act - Failure to stop doing something - R v Fagan
- Creation of danger - R v Miller
- However an omission can be actus reus in a number of situations:
