    • Governed by Sec 4 of Criminal Justice Act 1964 -          4(1) – ingredients are actus reus and mens rea 
      • Actus reus - Prove that their conduct, act or omission caused the unlawful death of the victim 
        • 3 parts of actus reus that must have a corresponding mens rea 1.      Conduct 2.      Circumstance 3.      Result
    • -          Causation – be alert to a novus actus interveniens breaking the chain of causation 
    • Mens rea – intention to kill or cause serious injury to some person -          You intend that if it was your aim, objective or purpose 
      • -          Presumed to have intended the natural and probable consequences of your actions – rebuttable
        • Sec 3 of Criminal Justice Act 1990 – capital murder
