• D is not convicted of murder under the C + J act 2009 if; 

1) s54 (1) (A): D's acts and omissions in doing or being party to the killing resulted from D's loss of self control - R V Jewell; loss of self control; losing the ability to act in accordance with considering judgement or a loss of normal of reasoning 

s54 (2) provides that D's loss of self control need to not be sudden - Davies; different individuals react differently

s54 (4) D cannot use the defence if acting out of a considered revenge - R V Jewell; acted out of revenge
