Conciliation

Advantages

  • Informal- conciliator is more active
  • Cheaper than courts
  • Flexibility- parties have full control of the process and are allowed to withdraw at any point. They decide the time and place that is convenient for the conciliation to take place.
  • Private
  • Conciliator is a legal expert- neutral and qualified

Disadvantages

  • Not legally binding
  • No decision is guaranteed
  • No appeal
  • No legal aid
  • No authority to see evidence or witnesses- all on the word off the parties

Evaluation

Conciliator is a neutral third party who actively tries to get the parties in the dispute to come to an agreement and are often qualified in conciliation techniques. They meet with the parties separately and go between the two suggesting solutions to the problem and to try to get the parties to compromise or reach a settlement. If a decision is reached, it is not legally binding unless agreed by both parties that it will be legally enforceable. Once conciliation is over, the parties can still go to court if an agreement has not been agreed.
