- Arson is found under S1(3) of the Criminal Damage Act 1971
- An offence is committed by destroying/ damaging property using fire
- Maximum penalty is life imprisonment
- The basic offence must be destruction or damage by fire
- All the same procedure are the same for basic offence

- Prosecution must prove defendant intended or was reckless as to whether life was endangered by damage/ destruction of fire
- The case of Miller explains arson can be committed through an omission, defendant accidentally started a fire, and failed to do anything to prevent damage
