Equality Act 2010
This act aims to harmonise all law on discrimination and produces a uniform approach and therefore, is written in plain English.
It REPEALS all relevant previous acts i.e. Equal Pay Act 1970, Sex Discrimination Act, Race Relations Act 1976, Disability Discrimination Act.
The Act identifies the principle the aim of equality , the protected characteristics, and the prohibited conduct.
The protected characteristics
These are found in SS4 - 12 & 18
- Age
- Disability
- Gender Reassignment
- Marriage and civil partnership
- Preganacy and maternity
- Race
- Religion and or belief
- Sex
- Sexual Orientation
The Protected Characteristics
Prohibited conducted is found in SS13-27
Prohibited conduct includes the following;
- S13 Direct Discrimination
- S14 Combined Discrimination
- S14 Indirect Discrimination
- S26 Harrasment
- S27 Victimisatin
There may also be a duty to make adjustment and failure to do so may amount to discrimnation and this is found in S20
