  • Coroner
    • conducts an investigation into a person's death if the coroner has reason to suspect that:
      • the deceased died a violent or unnatural death
      • the cause of death is unknown
      • the deceased died while in custody or otherwise in state detention i.e. youth offenders, prison, mental hospital
    • Purpose of an investigation
      • ascertain who the deceased was
      • ascertain how, when and where the deceased came by his or her death
    • Jury required?
      • An inquest into a death must be held with a jury if
        • the deceased died while in custody or otherwise in state detention
        • the death was either a violent or unnatural one
        • the cause of death is unknown
        • death of police officer or member of a service police force
        • death was caused by a notifiable accident, poisoning or disease
      • Only 7-11 members of jury in coroners court
    • Determination and findings to be made
      • After hearing the evidence at an inquest into a death, the coroner must;
        • ascertain who the deceased was
        • ascertain how, when and where the deceased came by his or her death
