What are the different sorts of sentencing?

1. Custodial 2. A fine 3. Community service: unpaid work, rehab, curfew, exclusion order. 4. Discharge: absolute discharge or conditional discharge.

What are the aggravating factors taken into account when sentencing?

1. Any previous conviction 2. Offence committed on bail 3. Group attack 4. Vulnerable victim 5. Premeditated 6. Weapon involved 7. Racial, religious, disability, sexual orientation motivation.

What are the mitigating factors taken into account when sentencing?

1. Minor injury 2. Provocation 3. Single blow 4. Age, mental state or physical illness of defendant 5. No previous convictions 6. Genuine remorse 7. Voluntary compensation 8. Guilty plea.

Aims of sentencing : deterrence

1. Individual: the sentence is designed so that the offender doesn't reoffend. 2. General: the prospect of punishment stops most people from offending.

Aims of sentencing : retribution

To punish the offender; if a person knows that they have done wrong then they deserve to be punished and that is what society expects.

Aims of sentencing : reparation

To repay the victim or community for what the defendant has done.

Aims of sentencing : rehabilitation

To solve the issues behind the offenders behaviour. If this becomes solved then this may stop them from reoffending.

Life imprisonment to those who commit murder or serious offences making it incapable of reoffending.

Society expressing its outrage at the behaviour of the individual and condemns it
