New Zealand national was forcibly returned to England. Trial did not take place due to the absence of an extradition treaty and therefore international law was not properly followed.

Police intercepted phone calls to obtain evidence that alleged criminality. It was argued this wasn't unlawful since something that is not specifically prohibited by law is therefore permitted. This was challenged at ECHR,it was unlawful.
