R v West (definition of robbery)
it is a theft that has been carried out through violence
1 of 6
R v Robinson (AR - steals)
it is necessary to prove all AR and MR elements of theft before considering whether there could a robbery. if there is no theft = no robbery
2 of 6
R v Hale (AR - immediately before or at the time of doing so)
the force (or threat of) must be before or during the theft, although this is not interpreted too strictly by the courts, and this can by a continuing act
3 of 6
R v West (AR - uses force or seeks to put person in fear of force)
the courts have indicated that violence (or threat of) is needed.
4 of 6
Cocoran v Anderton (AR - uses force or seeks to put person in fear of force)
however it is clear from cases the use of force can be small, e.g. snatching a bag from someone's grasp.
5 of 6
R v DPP (being then and there subjected to force)
the threat must be immediate, there is no given time limit though - this is a matter for the courts to decide. it does not matter whether the V was scared, just D intended to do so
