Section 2
Admission for Assessment. Detain the patient in hospital for assessment of a mental disorder for up to 28 days. Must be submitted in writing by 2 registered medical practitioners. From here, application for Section 3 can be made.

Section 3
Admission for Treatment. Detain the patient in hospital for treatment of a mental disorder for up to 6 months. Must be submitted in writing by 2 registered medical practitioners. Can be renewed or extended for 6mo. No limit on number of renewals.

CTO (Community Treatment Order)
A CTO can be made for a patient under Section 3. Allows the patient to be treated in the community for their mental health problem as long as certain criteria are met, otherwise the patient can be recalled to hospital.

Section 4
Admission for Assessment in Cases of Emergency. Application can be submitted by 1 registered medical practitioner. Effective for 72hrs from the time of hospital admission. From here, an application for Section 2 can be made.

Section 5(2)
Application for Detention of an Inpatient. The responsible clinician can apply for the detention of a voluntary inpatient (even those being treated for a physical problem). Effective for 72hrs from the time when the report is made.

Section 5(4)
Application for Detention of an Inpatient. A nurse can apply for the detention of a voluntary inpatient receiving treatment for a mental disorder. Effective for 6hrs from the time when the report is made.

Section 135
Warrant to Search for and Remove Patients. The justice of the peace may issue a warrant authorising police to enter premises and remove the patient to a place a safety. Effective for 24hrs. The view is to make an application for Section 2.

Section 136
Removal without a Warrant. The police may remove a person from a public space to a place of safety if they appear to be suffering from a mental disorder and are in immediate need of care/control. Effective for 24hrs.

Section 17
Grants a sectioned patient permission to leave the ward/hospital for a specified period of time

MHA Assessment Team [3]
(1) AMHP (approved mental health professional; e.g. social worker, nurse, OT, psychologist); (2) a registered medical practitioner (e.g. GP), (3) a Section 12 approved doctor (usually a psychiatrist)
