What is meant by a federal system?
A system of government, in which the powers and responsibilities are divided between a national and state/regional governments. They require written consitituations to allow for the settlement of disputes over the division of powers.

What is meant by the Rule of law?
The principle that all individuals are equal before the law. The rule assers that laws must be based on consent, involve consistent and accepted procedures and apply to the government as well as individuals.

What is meant by the term Natural Justice?
The right of all individuals to a fair trial, in which they are able to argue their case before an inbiased judge and where appropriate, be judged by their peers. Also allows the right to appeals of original trial had legal flaws.

Explain Judicial Independence
Key element in the SOP. Requires that a subsequent act of parliament can not overturn and exisiting judegment of a court in an individual case. Also - should not be possible for parliament to pressure the courts.

What is the adversarial system?
Legal system where parties can argue their cases before and unbiased third party for ajudication.

What is Common and Statute law?
Common law = Law based on previous judgments in the court. Statute law = Law that has been passed in parliament

What is precedent?
The basis for which a decision is made in a similar trial.

What is persuasive precedent?
Precedent that does not have to be followed. Set by lower courts. Can still influence judges decision in a case.

What legislative procedure?
The process by which a bill is passed in parliament.

What is cabinet?
Executive body of government.

What are private members?
A non executive member parliament. Do not hold an office.

What is a representative and responsible government?
Representative government represents the views and interests of the people. Responsible government is dervied from the westminister principles in which the executive must be supported by a majority of goverment, that itself answerable to the people
