They have the additional benefit to capitalism by helping to provide a fit and healthy workforce e.g. Health and Safety laws. So such laws can be seen as having an ideological function

They are enforced selectively. Crimes of the powerful, if discovered are rarely prosecuted. Those at the bottom of the class system who are caught are regularly prosecuted.
