What is the role of a magistrate?
They hear all summary offences and all pre-trail matters (bail, remand and sending 2 crown court hearings). They also hear some Triable Either Way cases. Can issue warrants for search/arrests.

TEW= criminal dam under £5000. Sum= most motoring offences. Indictable= murder. mag court doesnt hear them.

What happens if the Mag sentances someone?
If the D pleads guilty then the mag can sentance the D to a min of 6 months, a fine or a community sentance. If the court wanted a higher sentance they would send it to the CC and they would sentance them.

Advantages of changing Mag to District Judges.
DisJud are more qualified and have more training. Only 1 DJ would be needed instead of 3 Mag.
