Article 3 - Freedom from torture, inhuman & degrading treatment
No one shall be subjected to torture or to inhuman or degrading treatment or punishment.

Ireland v UK 1998
Torture - deliberate inhuman treatment causing very serious and cruel suffering.
Inhuman treatment- would cause intense physical and mental or psychiatric suffering.
Degrading treatment- behaviour that would arouse in the victim feelings

Birching held to be degrading treatment.

Article 3 - Chahal V UK 1997
- State may have positive obligation not to put someone in a position where they may be subject to treatment which breaches Art 3.
- UK under obligation not to deport Chahal to country where likely to be tortured.

Article 5 - Right to Liberty & Security
Everyone has the right to liberty and security of person. No one shall be deprived of his liberty.
A right not to be lawfully detained.

Everyone arrested to be informed promptly, and in a language he understands, of reasons for arrest and any charge (Art 5 (2)
