THEFT:
- S1 (1) TA 1968; a person is guilty of theft if he dishonestly appropriates property belonging to another with the intention to permantly deprive.
- APPROPRIATION S3 (1); any assumption by a person of the rights of an owner e.g moving, selling or using
- R V Morris: only need 1 right for assumption
- Lawrence V MPC: even if V consents, app can still happen
- R V Hinks: even acceptance of a valid gift sometimes will amount to an appropriation
- R V Pittham + Hehl: app can amount to D assuming V's property to sell
(also covers situations where property has come about innocently, but later been appropriated)
- PROPERTY S4; 1) property, 2) real property, 3) personal property, 4) things in action, 5) intangible
- Oxford V Moss: info cannot be stolen
- BTA S5 (1); possesion or control of the property or a propritary right / interest in the property
- R V Turner: D removed car out of garage without paying; jury found him guilty = possesion of garage
- Williams V Philipson: D's took various iteams out of bins, belonging to the council
