The Power of the Court
- The court can effectively interporate the constitution, Miller vs DC in 2008
- However the court cannot go too far in interperating the constitution, taking a step back in terms of abortion in 2018 case of Trump vs Hawaii
- Courts power of judicial review makes it politically powerful, Bush v Gore in 2000
- However cannot directly influence policy, upholding Affordable Care Act in NFIB v Sebelius in 2012
- Courts power of judicial review also makes it quasi legislative, recognising gay marraige in 2015 in obegerfell v hodges in 2015
- However cannot impliment that policy long term, ruling for masterpiece cake shop in masterpiece v colorado
- Courts position also means it can protect civil liverties, Roe V Wade in 1973
