There are other statutory powers available to PR's during the administration. In general these powers are not extended or modified by the terms of a will but in an individual case there may have been reasons for doing so and PRs should always examine the will for possible amendments.

Power to appoint a trustee re entitlement of a minor beneficiary

·   this is a way of dealing with the problem of good receipts on behalf of minor beneficiaries. A will often includes an express clause which simply allows a parent or guardian to give a good receipt rather than deal with the problem by appointing trustees(see below)

Power to Postpone Distribution

·   personal representatives are not bound to distribute in the ' executors year ' i.e. the year after death.
