Under Caparo v Dickman and more recently Donoghue v Stevenson, Amy must take reasonable steps to ensure that she does not injure those around her. If the damage is reasonably foreseeable, duty is owed.

As Amy was proximate to Nathan, it is reasonably foreseeable that damage could occur given the actions of Amy with the hot drinks.
