Duty of care can be found using 3 part test from Caparo v Dickman 

• Was some harmto someone in the Cs position RF?  Kent v Griffiths
• Was there proximity between the D and the C? Bourhill v Young/ Watson v British Boxing Board of Control 
• Is it fair/ just and reasonable to impose the duty of care on to the D? Hill v CCWY
