Is Supreme Court Imperial?


Imperial - controls, dominates and legislates US politics without the need of effective checks and balances

✔ SC has gained more power through judicial review - Marbury V Madison helped strengthen the federal judiciary - the power of judicial review gave judges power to impose restrictions on elected policy makers (accountable to voters).

Counter argument - some decisions can be overruled by federal judges (unaccountable)

✔increase in judicial activism - mainly focuses on rights (appealing to liberals/left leaners). E.g. 8th amendment (right not to have cruel/unusual punishments) changed to death penalty for convicted murderers only. creating more power for judges through judicial activism -
