  • Defendant does not have the intention to kill or cause serious harm, but their behaviour is blameworthy 

unlawful act- manslaughter 

1, D commits and unlawful act which must be a positive act (actus reus). The mens rea MUST be present to establish unlawful act.    R V LAMB

2, The act must be dangrous- judged by objective test, would a reasonable person foree the risk of harm         R V CHURCH

3, Act must have caused the death- the cusation tests apply "BUT FOR"
