- However ultimately it is the presidents decision, Bush invading Iraq without congressional approval in 2003 and Obama air strikes on Lybia
- The Supreme court can rule some foreign policy decisions unconstitutional, Trump travel ban in 2016
- However usually its up to the president, Obama opting into the Paris climate change agreement
- The war powers act of 1970 gives congress some oversight on how presidents run wars
- However historically this hasnt really worked, military involvement in Lybia and Syria not approved by congress
