Greek legislation prohibited the sale of processed milk for infants other than in pharmacists' shops except in municipalities possessing no such shop, in which case it could be sold in other shops. The Commission of the European Communities sought a declaration that such a prohibition was contrary to the Treaty of Rome 1957 Art.30 which prohibits quantitative restrictions on trade between Member States, arguing that the decision in Criminal Proceedings against Keck did not apply, since the Greek prohibition entailed a restrictive effect on trade by making the importation of the product from other Member…
