Applying Finnis' Natural law

To immigration:

  • Immigration: the action of going to live permanently in a foreign country
  • FOR:
  • Basic goods-
  • Friendship- you should extend the hand of friendship to all, even immigrants
  • Aesthetic experience- immigration opens up society to a wider variety of culture 
  • Religion- allows the consideration of different avenues to answer questions about life
  • Requirements of practical reason-
  • Should always take into account the good of others (the immigrants)
  • 'Do good and avoid evil'- it is morally good to help immigrants
  • Should foster the common good of the community- immigrants are part of a wider community
  • Act according to your conscience- helping immigrants is the morally right thing to do
  • AGAINST:
  • Basic goods-
  • Friendship- doesn't include people you don't already know
  • Aesthetic experience- allowing immigration could erode a cultural identity
  • Requirements of practical reason-
  • Foster the common good of the community- mass immigration may disrupt society
  • Other-
  • Finnis' recent articles argue controlled immigration is a good thing because the benefits outweigh the problems

To capital punishment:

  • Capital punishment: the legal authorisation of killing someone as a punishment for a crime
  • FOR:
  • Basic goods-
  • Friendship- if your friends are potential targets for a murderer for example, surely it would be acting in their best interests to eradicate the killer
  • Practical reasonableness- taking someone's life warrants a forfeit of your own?

  • Basic goods apply equally to all people- therefore it would be wise…
