Bail
Everyone has the right to bail under s4 of the Bail Act 1976 as amended by the Bail Amendment Act 1993
- Bail is : when the defendant is given liberty (freedom) until the next stage of the case
- The custody officer and magistrates court can grant bail
Bail under custody officer
- under S66 of PACE (Police And Criminal Evidence Act 1984) the custody officer can grant bail , although this can be refused if the c.o thinks you are lying about your name or address.
Substantial grounds
- if the courts think that the defendant will do any of the factors they will be refused bail:
- if they will commit an offence while on bail
- if they will surrender to custody
- if they will obstruct…
