Schechter Case

1935- 'Sick Chicken Case'

NY company owned by Schechter brothers, job was to deliever chickens to companies. 

One batch was unfit for human consumption -as they were sick

NRA fined them heavily because of it. The company did not accept decision taking it to the supreme court to challenge decisions

Inter-state commerce- between state

Intra-state commerce- within one state

Argued that it was not a federal issues as it was sold and eat in the same state, should be a state matter only 

Supreme court declared the NRA unconstitutional and that the company was right that they should not have got involved

This opened up the new deal to attack
