Homer Plessy claimed segregation was unlawful because it went against Fourteenth Amendment
state of Louisiana arrested him for sitting in a whites only area on a train
Plessy took his case to America's Supreme court
This was the start of 'seperate but equal' blacks and whites could stay segregated as long as their facilities were equally as good however this never happened.
