Medieval Law and Order
Law + Order very harsh in Medieval England
people only learned how to behave properly if feared wat would happen 2 them if broke the law
even smallest offences had serious punishments
each accused person had 2 go through ordeal
there were 3 ordeals
Ordeal by fire: accused person had to hold red hot iron bar + walked 3 paces. Hand was then bandaged & left for 3 days. If wound got better= innocent, didn't heal= guilty
Ordeal by water: accused person tied up & thrown into water. if floated= guilty
Ordeal by combat: used by noblemen who'd been accused of something would fight in
Medieval Law and Order no. 2
combat with their accuser. won fight= was right , lost= usually dead @ end
Henry ll (1154 - 1189) did not think methods were fair or sensible
wen henry ll came to thrown in 1154 first job was 2 restore oder & make everyone in England obey his laws.
by time of Henry ll, system of law in England had been improved coz Henry sent out his own judges from London 2 listen to cases throughout all England's counties.
In 1215 pope decided that priests in england must not help with ordeals.
as a result : ordeals were replaced by trails by juries
these were not popular with people as they felt their neighbors had grudge against them & used opportunity of trail 2 get revenge
Medieval Law and Order no.3
1275 a law was introduced which allowed people 2 b tortured if refused to go to trail before a jury.
if found guilty of a crime you would expect to face severe punishment
thieves: hands cut off
woman who committed murder = strangled and then burnt
illegal hunted: (royal parks) ears cut off
high treason: were hung drawn and quartered
very few prisons coz cost money (local communities not prepared to pay)
most towns had a gibbet just outside of it were people were hung and body left to rot over weeks as a warning to others
