What is Bail

Being given the LIBERTY until the next stage of the case

Police can release a suspect on bail while they make further inquiries

-Suspect is RELEASED on the CONDITION that they may return on a SET DATE

under s38 of PACE, custody officer may refuse to grant bail if

-Suspects name/address is not found

-Doubts whether name/address is GENUINE

What does the Bail Act State?

A suspect may be refused to be granted bail if the Police believe he/she will:

-OBSTRUCT WITH THE COURSE OF JUSTICE

-ANTECEDENTS

-PAST BAIL RECORDS

-AMOUNT OF RESEARCH EVIDENCE AGAINST SUSPECT

The Criminal Justice and Public Order Act 1994

CONDITIONS;

-ASKING THE SUSPECT TO SURRENDER SUSPORT

-REPORT TO THE POLICE STATETION REGULARLY

-SURETY- HAVING SOMEONE TO PAY FOR THE SUSPECT IF HE/SHE FAILS TO ATTEND COURT
