* Arson is found under S1(3) of the Criminal Damage Act 1971
* For basic offence, an offence of arson is committed through the destruction and damage by fire, resulting in arson. All the same elements for basic apply.
* Maximum penalty is life
* For aggravated offence, the porsecution must prove. Defendant intended or was reckless as to whether life was endangered by damage/destruction of fire.
* Miller = the case of miller explains arson, and stated it can be committed through an omission. Here defendant accidentally started a fire, and failed to do anything about it resulting in the death of three people
