The advantages of a codified constitution now outweigh its disadvantges- Discuss

Advantages

  • Gives us a much clearer view on our rights- written statement of our rights as citizens
  • Modernity- most modern democracies have a codified constitution and this would bring them up to date with them
  • Provides entrenchment-legal protection of laws, and prevents the whim of temporary governments (new governments cannot automatically repeal the laws of their predecessors)

Disadvantages

  • We already have a solid and stable government (to some extent, with the Coalition) without needing a constitution
  • Our uncodified constitution is flexible and helps us to move with the times- for example, the incorporation of the EU Convention of Human Rights in UK law
  • Flexibility means it can easily respond to public opinion- Firearms Amendment Act 1997 after the Dunblane Massacre and the Snowdrop campaign

Evaluation

I disagree, the uncodified constitution has worked effectively so far and the flexibility we have means that we can move with the times and there is not a complicated process to change it.
