Advantages

  • The act applies to both men and women although women have probably benefited more
  • The commissioning body is a strength of the act as it  raises awareness and monitors it
  • prevents indirect and direct discrimination, harassment and victimisation
  • covers actions and behaviours so anyone assisting can be considered under the act too
  • burden of proof lies with the perpetrator not the victim. The victim has to demonstrate that the action was discriminatory and the perpetrator for example the employer has to prove it wasn't.
  • secures equal treatment for gay men, lesbians, bisexuals and transgendered people

Disadvantages

  • Areas such as income tax, social security, benefits, immigration and nationality are covered by the act
  • Cost of taking a case to court
  • time consuming and too much effort
  • The law is complex and difficult to unravel
  • Fear of loosing employment if a complaint is made
  • It may be difficult if seeking redress to prove that certain actions have been taken and that direct/indirect discrimination has occurred
