Advantages

  • in June 2013, statistics published by the CCRC showed they had instigated 341 quashed convictions.
  • CCRC gives defendant an extra opportunity to challenge the criminal justice system.
  • CCRC has been seen to highlight very high profile miscarriages of justice.
  • CCRC is very accessible.

Disadvantages

  • not an appeal court, does not age the power to overturn an appeal or quash a conviction.
  • Can only consider cases which have been thriugh and failed the ordinary appeal routes.
  • severe backlog of cases- June 2013.608 cases were still waiting for consideration.
  • will often send the case back to the police for investigation - questions the independence.

Evaluation

Alan Traynor - convicted of murdering his girlfriend in 1993. The CCRC passed the case back to the Court of Appeal on the basis thst evidence that was previously inadmissible would now be admissible. The re-trial took place in March 2012 and the conviction was upheld. However, the CCRC were criticised for their involvement prior to this.
