  • Small Claims Track
    • Disputes under £5000, except personal injury cases and housing cases where the limit is usually £1000
    • People are encouraged to take their own case so costs are kept low
    • Small claims cases are started in the same way as other cases - which makes it more difficult for an ordinary person
    • Use of Lawyer is discouraged although you can ask to be legally represented. The winning party cannot claim the costs of the lawyer from losing party
    • Alternative to Lawyer is to have a "lay representative" who is not legally qualified but can help with your case
    • Small claims usually heard in private, but can be heard in an ordinary court
    • District Judges in small claim cases play an active role in the proceedings, asking questions and ensuring that both parties explain all their important points
