    • Solicitors may act as PR or on behalf of PR's
      • If acting on behalf of PR's must comply with general conduct rules
    • During administration PR's are the client. not beneficiaries.(must act on PR's instructions only)
    • During administration the solicitor instructed to act does so in both an advisor and executive capacity
      • this could involve:
        • Ascertaining deceased estate and the extent of any liabilities
        • Advising who is entitled to the deceased property
          • Will or intestacy rules?
        • Advising on the possibility of IPFDA claims and time limits
        • Advising on taxation matters, including the possibility of variation
        • Taking all steps to obtain the appropriate grant
        • Taking all steps to distribute and wind up the estate
