- If acting on behalf of PR's must comply with general conduct rules
- During administration PR's are the client. not beneficiaries.(must act on PR's instructions only)
- During administration the solicitor instructed to act does so in both an advisor and executive capacity
- this could involve:
- Ascertaining deceased estate and the extent of any liabilities
- Advising who is entitled to the deceased property
- Will or intestacy rules?
- Advising on the possibility of IPFDA claims and time limits
- Advising on taxation matters, including the possibility of variation
- Taking all steps to obtain the appropriate grant
- Taking all steps to distribute and wind up the estate
- this could involve:
