- 749 new deputies of the NC were mostly lawyers, professionals or property owners. A very small amount of nobles or clergymen and new to the scene were few artisans. Their first decision was to abolish monarchy.

- Girondins v Jacobins/Montagnards
- Clear division, on high benches to left were Monts 'the Mountain', on the right were Girons. Both groups were members of the Jacobins. The plain sat uncommitted in the middle.
- They fought political battles over the conduct of the war, dealing with the King and personal antagonisms.
- Girons accused Monts of wanting political dictatorship, and also of the Sept Massacres.
- They were also hostile to the SC and their popular radicalism; they stood behind the Monts.

- Girons wanted trial and to hold Louis as hostage for negotiation with Austrians and Prussians. For the sentence they wanted a referendum of the people; believing the Provinces wouldn't agree with Paris.
- Monts viewed as guilty of treason. For the sentence Robespierre argued with them for the death penalty.
- NC agreed with Girons trial but the penalty was left to a vote on Marat's suggestion.
