  • COA Extension of Powers.
    • For
      • Little cases actually get appealed beyond the COA to the SC which means that errors in the law go unnoticed for many years. e.g Criminal damage and R V G and Another.
      • Would improve the flexibility of the DOP
      • Will allow justice to happen more quickly as the wrongly convicted can appeal even quicker.
    • Against
      • Reduces the certainty and predictability of the law. Bc there are two conflicting decisions for the lower courts to choose from. This makes decision making and legal advice for the lower courts difficult
      • It could cause the number of appeals to become higher and make the COA unable to view important appeal cases.
      • Undermines the power and role of the SC as the COA practically has the same power as them which could cause conflict between the two courts and could make people reluctant to use this power.
